Terms & Conditions — The United Mortgage

These Terms & Conditions ("Terms") govern your access to and use of the-united-mortgage.webflow.io and theunitedmortgage.com (the "Site"), including the Loan Quote Survey and any related tools (collectively, the "Services"), provided by [Legal Entity Name, e.g. "The United Mortgage, LLC"] ("The United Mortgage," "we," "us," or "our"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Who We Are

The United Mortgage is a licensed mortgage brokerage that helps consumers explore home purchase, refinance, and cash-out refinance options by connecting them with third-party lenders and financial institutions ("Lending Partners"). We do not directly fund, underwrite, or service mortgage loans.

2. Not a Lender; No Guarantee of Approval or Terms

The United Mortgage is a broker, not a lender. We do not guarantee approval for any loan, any specific interest rate, or any specific loan terms. Rate estimates, program eligibility indications, and quotes provided through the Site or the Loan Quote Survey are for informational purposes only, are not a loan offer, are not a commitment to lend, and are not a guarantee of final terms. Actual rates, terms, and approval are determined solely by the applicable Lending Partner based on full underwriting, your creditworthiness, property valuation, and other factors, and are subject to change without notice.

This is not an advertisement for credit as defined by Regulation Z, unless and until specific rate and term information for an actual product you qualify for is provided to you directly by a licensed loan originator or Lending Partner in compliance with applicable disclosure requirements.

3. The Loan Quote Survey

The Loan Quote Survey collects information about your financial situation, property, and homeownership goals so that we can identify potentially suitable loan programs and Lending Partners. By submitting the survey, you represent that the information you provide is true, accurate, and complete to the best of your knowledge. Submitting the survey does not constitute a loan application, and no credit decision is made based solely on survey responses.

By submitting the survey or otherwise providing your contact information, you consent to be contacted by The United Mortgage and, where applicable, our Lending Partners, by phone, text message (including by autodialer or prerecorded message), and email regarding your inquiry, even if your number is on a federal or state Do-Not-Call registry. Consent to be contacted is not a condition of obtaining any loan, and you may revoke consent at any time as described in our Privacy Policy.

4. Eligibility

You must be at least 18 years old and capable of entering into a legally binding agreement to use the Services. The Services are intended for residents of states where The United Mortgage and its Lending Partners are licensed and authorized to operate.

5. Acceptable Use

You agree not to:

  • Provide false, misleading, or fraudulent information in the survey or any application
  • Use the Services for any unlawful purpose or in violation of any applicable law or regulation
  • Attempt to gain unauthorized access to the Site, its systems, or related accounts
  • Interfere with or disrupt the integrity or performance of the Site
  • Use automated means (bots, scrapers) to access the Site without our prior written consent
  • Submit information on behalf of another person without their knowledge and authorization

6. Third-Party Lenders and Links

The Site and our process may reference, link to, or route you to third-party Lending Partners, lenders, or service providers. We do not control and are not responsible for the content, products, services, privacy practices, or terms of any third party. Your use of any third-party service is governed by that party's own terms and privacy policy.

7. Intellectual Property

All content on the Site, including text, graphics, logos, images, and software, is the property of The United Mortgage or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Site without our prior written permission, except as necessary to use the Services for their intended personal, non-commercial purpose.

8. Disclaimers

THE SERVICES, INCLUDING ALL RATE ESTIMATES, PROGRAM INFORMATION, AND CONTENT, ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. THE UNITED MORTGAGE DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY ESTIMATE OR INFORMATION PROVIDED WILL RESULT IN LOAN APPROVAL OR ANY PARTICULAR LOAN TERMS.

Nothing on the Site constitutes legal, tax, or financial advice. You should consult your own licensed loan officer, financial advisor, attorney, or tax professional before making decisions about mortgage financing.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE UNITED MORTGAGE, ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES OR ANY LOAN PRODUCT OFFERED BY A LENDING PARTNER, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICES WILL NOT EXCEED ONE HUNDRED DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless The United Mortgage and its owners, officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Services, your violation of these Terms, or your violation of any law or third-party right.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of [Governing State, e.g. California], without regard to its conflict-of-laws principles, except where preempted by federal law applicable to mortgage brokerage activity.

Any dispute arising out of or relating to these Terms or the Services will be subject to the exclusive jurisdiction of the state and federal courts located in [County, State], and you consent to personal jurisdiction in those courts. 12. Changes to These Terms

13. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and The United Mortgage regarding the Services and supersede any prior agreements regarding the same subject matter.
